Whales in the Courtroom

Whales, whaling, and resistance to whaling have been on the agenda in courtrooms around the world in the past few years. On March 31. 2014. the International Court of Justice issued a landmark ruling on Japan’s whaling program for minke, fin, and humpback whales under the International Whaling Convention. Meanwhile, cases are ongoing before domestic courts around the world on the activities of conservation groups that have tried to stop whaling fleets, with groups like Sea Shepard accused of piracy. Courts have also had to grapple with claims by some indigenous groups for whaling rights. Professors Wiersema, Marceau, and Pidot will talk about the IJC decision, the 9th Circuit litigation against Sea Shepard, and tribal claims to whaling rights.
