ADR in Criminal Law
The criminal justice system is one of the most recent ADR adopters and has been gaining popularity in many parts of the U.S. and around the world as an alternative to traditional retributive justice. Restorative practices generally bring the offender, the victim, and the affected community meet in the presence of trained facilitators to discuss the incident and the behavior and to seek solutions. The offender, the victim, and the community each has equal responsibility within the process, and solutions are achieved through consensus. Currently, restorative justice is most often used in juvenile cases.1
