Denver Law faculty lead successful First Amendment challenge

Denver Law professors Justin Marceau and Alan Chen helped represent a broad coalition of animal rights and civil rights groups in bringing a challenge to Idaho’s anti-whistleblower law known as the Ag-Gag law. This law criminalizes undercover investigations and traditional whistleblowing by long-term employees in the agricultural industry. The federal district court in Idaho resoundingly struck down the law. It was a total victory, striking the law down on both free speech and equal protection grounds. The laws in other states are very vulnerable now and will be challenged. In one particularly notable line the federal judge responded to the State’s argument that this law is necessary in order to protect the privacy of the industry: “Protecting the private interests of a powerful industry, which produces the public’s food supply, against public scrutiny is not a legitimate government interest.” Read the full memorandum online.
