Course Description

Indian Water Rights | L47xx

This course begins with an introduction to water law, with an emphasis on water law in the western states, and continues with an introduction to the legal history of Indian tribes in the United States, including discussions of tribal sovereignty and congressional power over Indian tribes. The course will then focus on the unique attributes of Indian reserved water rights. This will include discussions on the adjudication and settlement of Indian water rights claims, and how those water rights play a central role as tribes pursue long-term economic security.
